Regulations for Womb Rental Updated
In keeping with the current PRE Stud Book procedures, the breeder of a foal is the owner of the dam at the time of foaling Therefore, it is essential that all breeders who purchase a broodmare and will be breeding with her, request a change of ownership prior to the birth of the filly/colt
The documentation for the rental of wombs is, in many cases, being used incorrectly A given breeder appears as the breeder of a foal, when that is not the case, and without being the true owner of the dam when the foal is born, and without having foaled on his/her stud farm These events have major consequences at competitions For example, this undermines the results of stud farms who are seeking the Best Breeder Award
Therefore, it is essential that the specifications defining what a true womb rental is or isn’t must be established:
A rented womb arises due to the desire of a breeder to breed a foal out of a mare, when that mare is actually owned by another breeder Such an agreement must be clearly indicated in the womb rental contract
Therefore, the first prerequisite that must be met is that the womb rental contract must be filled out and signed by all interested parties This contract must be presented at the PRE Stud Book office at least eight 8 months prior to the birth of the filly/colt The logics behind renting a womb begin well before the mare is pregnant and an agreement is made between the breeder-lessee of the mare and the owner of the sire Therefore, when the mare is covered/inseminated—which is when the final agreement is reached and appropriately established—the womb rental contract must be signed and presented at the PRE Stud Book office The PRE Stud Book web site provides a basic model
Due to the importance of this document, the lease between the two breeders involved must signed and the signatures certified by a Notary

De acuerdo al procedimiento de actuaciones del Libro Genealógico, el criador de un potro es el titular de la madre en el momento del parto Por tanto es fundamental que todos aquellos ganaderos que compren una yegua madre y vayan a criar con ella, soliciten el cambio de titularidad de la misma antes del nacimiento del potro/a
La utilización del documento de alquiler de vientre se está realizando en muchos casos de forma incorrecta, para que un determinado ganadero aparezca como criador de un potro sin haberlo sido realmente, sin haber sido el titular de la madre en el momento del parto y sin haber nacido en su casa Esto tiene consecuencias en los concursos, por ejemplo, en los que se desvirtúan los resultados de las ganaderías que optan al premio de mejor ganadería criadora
Por tanto, es necesario definir las condiciones para distinguir lo que verdaderamente es un alquiler de vientre de lo que no lo es:
El alquiler de vientre surge por la intención de un ganadero de criar un potro de una yegua, cuando la yegua realmente es propiedad de otro ganadero Dicho propósito debe quedar perfectamente plasmado en los contratos de alquiler de vientre
Por tanto, la primera exigencia que es necesario cumplir es que dicho contrato de alquiler de vientre, debidamente cumplimentado y firmado por las partes interesadas, deberá ser presentado al LG al menos 8 meses antes del nacimiento del potro/a La decisión lógica de realizar un alquiler de vientre se toma antes de la cubrición de la yegua y se consensua con el dueño de la yegua el semental que se va a elegir, etc Por tanto, en el momento de la cubrición, que es cuando se acuerda y se conoce fehacientemente esa intención, se debe firmar el contrato de alquiler de vientre y presentarse al LG Existe un modelo orientativo disponible en la nuestra página web
Debido a la importancia que tiene este documento, el documento de alquiler de vientre suscrito entre los dos ganaderos implicados, deberá constar de firmas autenticadas ante notario
Esta medida no será de aplicación inmediata, pues ya existen contratos de alquiler de vientres firmados con anterioridad a la publicación de esta noticia y que pueden no cumplir los requisitos aquí establecidos
Por tanto, a partir de este momento se establece un plazo de 1 mes, a contar a partir del día siguiente al de la publicación de esta noticia, para que todo aquel ganadero que disponga ahora mismo de un contrato de alquiler de vientre firmado con anterioridad al día de hoy los que correspondan a potros todavía no inscritos, potros todavía no nacidos, etc etc, lo comunique inmediatamente al LG
A partir del día 30 de noviembre de 2014, TODOS los alquileres de vientre tendrán que cumplir el procedimiento aquí establecido: deben ser presentados al LG al menos 8 meses antes del nacimiento del potro/a y deben contener la firma autenticada ante notario
